SRINAGAR, Dec 11: The High Court of Jammu & Kashmir and Ladakh has issued a notice to the J&K government regarding a petition that challenges the current reservation policy.
The court has requested the government to respond to the plea, which questions the existing reservation guidelines in the region. The division bench, made up of Justice Rajnesh Oswal and Justice Mohd.
Yousuf Wani, directed the J&K government and other respondents to submit their replies within three weeks during a hearing on November 9.
Additionally, the court instructed the petitioners to complete necessary procedures for service in one week. The petition was initiated by Dawar Ali, with backing from the Jammu & Kashmir Civil Society.
It was presented by Team JUS Advocates & Solicitors Front from New Delhi, led by Advocate Junaid Mohammad Junaid. The petition challenges the justification for the government’s existing reservation policy, claiming it breaches principles of fairness and reason.
It calls for the establishment of an independent committee to assess and rationalize the reservation system within a defined timeline, ensuring a fair and transparent process.
The next court hearing is set for December 27. Earlier this year, the Union Territory administration, under Lieutenant Governor Manoj Sinha, enacted a 10% reservation for the Pahari community.
This adjustment raised the total reserved seats across various categories to 60%, leaving only 40% available for general category candidates. As a result, there has been unrest among Open Merit aspirants who are demanding a review of this new policy.
